BLAIR — Landowner Val Green has brought the paving of Chinook Drive to another standstill although this stoppage could be longer than just temporary.


At 4:40 p.m. Oct. 18, Green presented Fairfield County attorney Jack James and Sanders Brother Construction with a restraining order to prevent Chinook Drive from being paved.


Jeff Betcher, superintendent of paving for Sanders Brothers Construction, confirmed his company’s name was on the restraining order, but could not comment any further.


The paving company will be paid for the jobs already completed and will pick up their paving equipment that has been waiting outside Chinook Drive.


“For this year we’ve won the battle so far,” Green said.


A hearing on the restraining order is scheduled for Nov. 8 in Winnsboro.


In the hearing, Green said his lawyers will point out the county’s inconsistencies in the paving program and how it doesn’t fit the law.


In documents provided to The Herald Independent, the county proved maintenance for 14 years, but not the 20 years needed for prescriptive easement. County officials did state there were more records available electronically, but could not provide documentation.


Green believes the County Transportation Committee made a mistake when adding up the priority points in the formula. Under the old formula — which Chinook was the last road to be paved — a road needed 27.5 points to qualify.


“I still can’t come up with how they got to 27.5,” Green noted. “So all this evidence combined should be enough for the judge to give us a more permanent injunction.”
